Velaya Experience (hereinafter "Velaya Experience", "We", "Us", "Our") operates the website available at www.velayaexperience.com (the "Website") and offers Clients stays in carefully selected villas and properties with associated services (the "Stays" or the "Services").
Velaya Experience is a company registered with the Companies Registry under number _______, VAT no _____, Atout France Registry no.: ________, with its registered office at ____________, Tel.: _______, email: contact@velayaexperience.com. The Website's publishing manager _____________. The Website is hosted by GoDaddy and Webflow.
These Client Rental Terms and Conditions (the "Terms") apply to all bookings of Stays made directly with Velaya Experience or through the Website by any client (the "Client").
By confirming a booking, the Client acknowledges having read and accepted these Terms. If the Client does not accept the Terms, no booking can be finalised.
Stays offered by Velaya Experience are seasonal rentals for leisure purposes. They do not constitute residential leases or mixed residential and professional leases.
For the purpose of these Terms:
The Client selects one or more Properties on the Website or with Our team. A detailed description of each Property and its included Services (the "Description") is shared before any booking.
The booking process generally includes the following steps:
All prices are indicated in euros and include applicable VAT, unless stated otherwise. The price includes use of the Property during the booked dates and the Services stated in the Description.
City or tourist taxes that may be applicable in the destination are not included unless explicitly stated. They are payable by the Client and may be collected by Velaya Experience on behalf of local authorities.
Unless otherwise specified in the Contract:
Payments are made by bank transfer or through a secure payment provider indicated by Velaya Experience. Any bank fees are borne by the Client.
If the Client fails to pay any amount on the due date and does not regularise the situation after a reminder, the booking may be considered cancelled by the Client in accordance with the cancellation conditions below.
A security deposit may be requested to cover any damage or loss in the Property, as well as unpaid services or local taxes. The amount and method of payment are specified in the Contract.
After check out and verification of the Property, the security deposit is returned to the Client within a reasonable period, minus any justified amounts retained to cover damage, excessive cleaning, missing items or unpaid sums. Evidence may be provided upon request.
Unless more favourable or specific conditions are stated in the Contract, the following fees apply:
Any request for cancellation must be sent in writing to Velaya Experience. The effective date is the date of receipt of the written request.
Any request to change dates, Property or guest details is subject to availability and approval by Velaya Experience and the Owner. Additional administrative fees and any difference in price may apply. A change is only effective once confirmed in writing by Velaya Experience.
If Velaya Experience must make a significant change to the booked Stay or cancel it for reasons other than a breach by the Client, We will inform the Client as soon as possible and propose, where possible, an alternative Property or dates of an equivalent level.
If no satisfactory alternative is available, the sums already paid for the Stay will be refunded. This refund constitutes the main remedy for the Client, without prejudice to any mandatory legal rights.
If Exceptional and unavoidable circumstances at the destination or near the Property make the Stay impossible or significantly unsafe according to objective information, Velaya Experience and the Client may agree to modify or cancel the Stay. The financial consequences will be handled in good faith and in accordance with applicable law.
Unless stated otherwise in the Contract, check in takes place from 5 p.m. local time and check out no later than 10 a.m. local time.
Early check in or late check out may sometimes be organised subject to availability, written agreement and possible additional fees.

Unless expressly authorised in writing, it is forbidden to organise events, parties or commercial activities (such as photo or video shoots open to the public) in the Property.
Smoking inside the Property is not allowed unless explicitly indicated in the Description. Pets are only accepted with prior written agreement. Additional cleaning fees or specific deposits may apply.
The Client must inform Velaya Experience promptly of any damage, malfunction or incident occurring in the Property during the Stay. The Client is responsible for any damage caused by them or the guests they have invited, beyond normal wear and tear.
The cost of repairs, replacement or extra cleaning may be deducted from the security deposit or invoiced separately if the deposit is insufficient.
Some Properties include facilities such as pools, hot tubs, gyms or wellness areas. The Client uses these facilities under their own responsibility and must comply with all safety instructions, in particular for children, who must be supervised at all times by a responsible adult.
Properties are often located in natural environments where insects and local wildlife may be present. Velaya Experience cannot be held liable for their presence or for any disturbance or exterior noise beyond its control.
The Client is informed that, under applicable consumer law, there is no legal right of withdrawal for the provision of accommodation services for a specific date or period. Once a dated Stay is confirmed, the Client cannot cancel it without fees, except where expressly provided in these Terms or by mandatory law.
The Client is strongly advised to take out appropriate insurance covering, in particular, civil liability during the Stay, damage to rented property, theft and trip cancellation. It is the Client's responsibility to verify the scope and conditions of their own insurance cover.
Velaya Experience is responsible for the proper organisation of the Stay in accordance with the Contract and applicable law. However, Velaya Experience cannot be held liable for:
Except where prohibited by law, any financial liability of Velaya Experience is limited to three times the total price of the Stay, excluding bodily injury or intentional misconduct.
Personal data collected in connection with a booking is processed by Velaya Experience in accordance with its Privacy Policy available on the Website. The Client can exercise their rights regarding personal data by contacting contact@velayaexperience.com.
Any difficulty during the Stay should be reported as soon as possible to Velaya Experience so that a solution can be sought while the Client is on site whenever possible.
Any complaint after the Stay should be sent in writing with supporting documents within a reasonable period to: contact@velayaexperience.com.
These Terms and any Contract concluded with Velaya Experience are governed by French law, without prejudice to any mandatory consumer protection rules that may apply. In the absence of an amicable solution, disputes will be submitted to the competent French courts.
